In consideration of credit extended by Earth Stone Rock (the "Seller"), the applicant ("Customer") agrees:
- Payment terms are net 30 days from invoice date unless otherwise agreed in writing.
- Past-due balances accrue a finance charge of 1.5% per month (18% per year), or the maximum rate permitted by applicable law, whichever is less, from the due date until paid, including after judgment.
- Payments are applied first to finance charges, then to the oldest outstanding balance.
- On default, the entire outstanding balance becomes immediately due and payable at Seller
- If the account is opened on the application of more than one person or entity, each is jointly and severally liable for all amounts owed.
- This Agreement is governed by the laws of the State of California, and Customer consents to venue and jurisdiction in the county of Seller
- Customer authorizes Seller to obtain and verify credit and banking information from the references provided and from credit reporting agencies, now and while the account remains open.
- Billing disputes must be submitted in writing within 30 days of the statement date; undisputed amounts remain due.
Personal Guarantee. The undersigned, individually and (if more than one) jointly and severally, personally and unconditionally guarantees the full and prompt payment of all amounts owed to Seller by Customer and agrees to be personally liable for all indebtedness on the account. This guarantee is continuing and remains in effect until all obligations are paid in full.
